中机国际招标公司（以下称采购代理机构）受中华人民共和国商务部（以下称采购人）的委托，以公开招标方式选择商务部律师事务所库—贸易救济子库律师事务所（招标编号：0702-1341CITC5C20)，邀请符合资格条件的律师事务所（以下称投标人）参加投标。
CMC International Tendering Company (hereinafter referred to as “the Procurement Agent”), entrusted by Ministry of Commerce of the People's Republic of China (hereinafter referred to as “the Purchaser”), now invites eligible and qualified law firms (hereinafter referred to as “the Bidder”) to submit sealed bids for selection of law firms’ entry into the Ministry of Commerce’s Candidate List of Law Firms —sub-list for Trade Remedies(Bid No.: 0702-1341CITC5C20) by public competitive bidding.

二、投标人资格
Qualifications of the Bidder
投标人应当具备下列条件：
The Bidder shall meet the following conditions:
（1） 投标人应为合法注册的律师事务所,投标人国籍应与包（子库）名称相符。第1包中国律师事务所投标人应为在中国大陆注册的律师事务所；
Bidders shall be legally registered law firms. The nationality of Law firms should conform to the Package (Sub-list of Law Firms). Bidders for Package 1 shall be registered in the mainland of China;
（2） 具有独立承担民事责任的能力；
Having the ability to independently undertake civil liabilities;
（3） 具有良好的商业信誉和健全的财务会计制度；
Having good business reputation and sound financial and accounting system;
（4） 具有承办委托法律服务事项的团队和能力。
Having a team with the ability to provide the entrusted legal services.
（5） 第1包投标人应有依法缴纳税收和社会保障资金的良好记录;
Bidders for Package No.1 shall have a good record of paying taxes and social security funds in accordance with the laws of P. R. China;
（6） 已购买本项目招标文件。
Having bought the Bidding Document of this project.
三、招标文件的获取方法
Method of Obtaining the Bidding Document
（1） 本项目招标文件为PDF格式电子文件，投标人可在网上购买下载。
Document is an electronic document in PDF format, which can be purchased by interested Bidders online for download.
（2） 招标文件发售时间：2013年9月18日上午9：00到2013年10月17日下午4:00。（北京时间）
Time Availability of the Bidding Document: starting from 9:00am September 18, 2013 to 4:00 pm October 17, 2013. (Beijing Time)
（3） 招标文件售价：每包500元人民币（或等值的美元或欧元），售后不退。
The price of the Bidding Document is RMB500:00 Yuan (or the equivalent in U.S. Dollars or Euros) per package, which is non-refundable after sale.
（4） 投标人可通过浏览附件1以了解本项目服务要求。如需购买招标文件，可通过银行将标书款电汇至中机国际招标公司账户。
Bidders may browse Annex 1 to see the service requirements of this project.If intending to buy the Bidding Document, the Bidder may transmit the Bidding Document fees by telegraphic transfer (T/T) to the account of CMC International Tendering Company.

如投标人通过在中国通用招标网（www.china-tender.com.cn）下载的方式获取招标文件， 投标人须在中国通用招标网（www.china-tender.com.cn）注册（注册帮助电话：010-63348126，010-.；联系人：刘青刚、李国梁）。注册完成后，将标书款银行汇款凭证扫描件发电子邮件至houchen@citc.genertec.com.cn。采购代理机构将在收到邮件后12 小时内开通投标人下载招标文件权限。
To download the Bidding Document on “www.china-tender.com.cn”,Bidders should register on “www.china-tender.com.cn”(Register assist Tel.:+ 86 10-63348126，+ 86 10-.;Contact person: Liu Qinggang, Li Guoliang ). After successfully registered， the Bidder should send the scanning copy of Bank Transfer Voucher of the Bidding Document fees to the email address of “houchen@citc.genertec.com.cn”. The Procurement Agent will give the Bidder permission to download the Bidding Document within 12 hours after receipt of the said email.
因中国通用招标网（www.china-tender.com.cn）只有中文界面，第2包和第4包投标人还可通过电子邮件方式获取招标文件。投标人须填写“购买标书申请表”(见附件2）并将该表与标书款银行汇款凭证扫描件发电子邮件至houchen@citc.genertec.com.cn以索取本项目招标文件。采购代理机构将在收到邮件后12小时内将招标文件电子版发送给投标人。
As Genertec Bidding Web site (www.china-tender.com.cn) only has the Chinese interface, Bidders for Packages No. 2 and 4 can also obtain the Bidding Document by e-mail. However Bidders must fill out an “Application Form for Purchase of the Bidding Document" (see Annex 2) and the scanned “Application Form for Purchase of the Bidding Document" and bank transfer voucher for the Bidding Document shall be sent by email to houchen@citc.genertec.com.cn for purpose of obtaining the Bidding Document of the project. The Procurement Agent will e-mail the electronic version of the Bidding Document to them within 12 hours after receipt of such an email.
标书款发票可于2013年10月18日起在通用技术大厦一层标书室领取。
The invoice of the Bidding Document fee may be obtained form Bidding Document Office on the 1st floor in Genertec Plaza since October 18, 2013.

四、投标
（1）投标截止时间：2013年10月18日9:30（北京时间）
Deadline for Bid Submission: 9:30am October 18, 2013, (Beijing Time)
（2）投标保证金：每包7000元人民币（或等值的美元或欧元）（确定中标人后5个工作日内退还保证金及利息）。银行账户信息同支付标书款的账户信息。投标保证金须在投标截止时间之前提交至中机国际招标公司。
The amount of the Bid Security: RMB 7,000.00 yuan or equivalent of US Dollars or Euros per package(The bid security and its interest will be returned within five working days after Notification of Award is issued). The information of the Bank Account is the same as the account information of the payment for the Bidding Document.
（3）中标服务费：投标人如中标，每包应向采购代理机构缴纳7000元人民币（或等值的美元或欧元）中标服务费。如投标人还在商务部律师库其他子库中标，每包应缴纳5600元人民币。
The bidding service fee: If winning the bid，the Bidder shall pay RMB 7000 yuan or equivalent of US Dollars or Euros per package to the Procurement Agent. If winning other bid in other sub-list of the Ministry of Commerce‘s Candidate List of Law Firms, the Bidder shall pay RMB 5600 yuan or equivalent of US Dollars or Euros per package.

六、开标
6. Bid Opening
采购代理机构将于2013年10月18日9:30（北京时间），在通用技术大厦三层第一会议室举行开标仪式。投标人可派代表出席。

第一部分：律所工作事项和内容
Part 1: Law Firm’s Work Items and Contents
在中华人民共和国法律法规允许的范围内，协助提供以下服务：
The law firm shall assist in providing the following services within the scope of the laws of the People's Republic of China:
一、为中国政府应对国外对华贸易救济原审案件、复审案件以及相关的行政复议和司法审查案件提供法律服务，主要包括但不限于：分析、运用世贸组织等相关国际规则和有关国家贸易救济国内规则，提供案件应对策略分析；收集、整理和翻译法律文件和证据材料；参与准备相关问卷答复和法律文件；参加案件调查过程中的实地核查、听证和工作会议；参与案件调查中相关程序性工作；总结评估案件等。
１．Provide legal services for the Chinese government to participating in foreign trade remedy cases, reviews and related administrative reinvestigations and judicial reviews, including but not limited to: analysis, use of WTO and other relevant international rules and domestic trade remedy rules of the countries concerned, providing case analysis of coping strategies; collect and translate legal documents and evidence; involved in the preparation of legal documents related to the questionnaire responses; participate in verifications, hearings and working meetings during the course of investigation; involved in the procedure work during the course of investigation; provide summary assessment of cases; and so on.
二、就其他国家贸易救济政策和法规的调整、修改等事项，为中国政府提供法律咨询，准备法律意见和总结评估。
２． Provide legal advices, preparing legal opinions and summary assessments for the Chinese government with regard to the adjustment, amendments and other matters concerning trade remedy policies and regulations in other countries.
三、应中国政府要求，就与贸易救济相关的其他问题提供法律服务。
３． At the request of the Chinese government, provide legal services for other issues related to trade remedies．
第二部分：律所工作质量要求
Part 2: The Quality Requirements for the Law Firm
一、关于工作内容的要求The requirements on content of work
（一）精通贸易救济调查涉及的主要法律问题。
Being proficient in the main legal issues involved in trade remedy investigations.
（二）能够熟练收集并精通案件事实。
Being able to skillfully collect and master the facts of cases.
（三）精通所涉国家国内规则、世贸规则以及对相关规则的重要解释、运用等。
Having good command in the internal rules of relevant countries and WTO rules and important interpretations and use of the relevant rules.
（四）能够深入分析案件的意义，如对国内、国际规则的发展，对国内外贸易可能带来的影响等。
Having the ability to give detailed analysis of the significance of cases, such as potential impact on the development of the domestic and international rules, and the domestic and foreign trade, etc..
（五）能够基于案件实际情况提出法律建议。
Being capable of putting forward legal suggestions based on the actual situation of cases
二、关于工作程序的要求The Requirements on Procedures of Work
（一）能够与委托方、其他受托律所（如有）、相关部门等单位密切配合、积极合作。
(1) Able to work closely and cooperate actively with the principal, or other law firms entrusted (if any), relevant departments and other units.
（二）工作积极主动，富有前瞻性、计划性和系统性。
(2) Working in a proactive, forward-looking, planned and systematic manner.
（三）能够将相关工作文件及时梳理、归档并交付委托方。
(3) Able to sort and archive relevant working documents and deliver them to the principal in a timely manner.

团队成员数量充足，且具备提供符合工作质量要求的法律服务的专业水准和相关经验。
The number of team members should be sufficient, and have the professional skills and relevant experience in offering legal services that can meet the quality requirements of such services.
二、关于工作态度的要求
Requirements on Attitude toward work
团队成员恪尽职守，并保持必要的谨慎和勤勉，严格按工作时限完成工作任务。
The team members should fulfill their duties, maintain the necessary prudence and diligence, and complete the work strictly according to the deadlines.
